Terms of Service

Welcome to HotelHook ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the HotelHook website, the free code management software, and your purchase of physical custom-printed referral cards (collectively, the "Services").

By registering an account, accessing the software, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. DESCRIPTION OF SERVICE

HotelHook provides a hybrid service to accommodation businesses ("Customers"):

• Physical Goods: The custom design, printing, and shipping of physical referral cards containing unique QR codes and text.
• Digital Software: A free, web-based dashboard and verification engine used to manage, validate, and track the unique codes printed on the physical cards.

2. PHYSICAL ORDERS, SHIPPING, AND REFUNDS

2.1 Custom Goods Exemption

Because every batch of HotelHook cards is custom-printed using your specific hotel name, logo, and uploaded photography, all sales are final. We cannot accept returns or offer refunds for "change of mind" once an order has entered the printing process.

2.2 Proofing and Errors

You are responsible for ensuring that all text, logos, and images uploaded for your cards are correct. HotelHook is not liable for spelling errors, low-resolution image pixelation, or incorrect contact details provided by the Customer.

2.3 Manufacturing Defects and Lost Shipments

If the cards arrive with a physical manufacturing defect (e.g., misaligned cutting, ink smearing) or if the shipment is officially declared lost by the carrier, HotelHook will, at its sole discretion, either reprint and reship the defective/lost batch at no extra cost or issue a refund for the physical order.

3. INTELLECTUAL PROPERTY AND WARRANTIES

3.1 Your Content

By uploading photos, logos, or other branding materials ("Customer Content") to our Services, you represent and warrant that you own the rights to use, display, and reproduce such content. You agree to indemnify and hold HotelHook harmless against any copyright infringement claims arising from the printing of the materials you provide.

3.2 HotelHook's Property

The underlying software, algorithms, code generation logic, database structure, and the HotelHook brand identity remain the exclusive intellectual property of HotelHook. You are granted a limited, non-transferable license to use the software solely for managing your purchased cards.

4. SOFTWARE USE AND UPTIME

4.1 "As-Is" Provision

While we strive for 99.9% uptime, the digital verification software is provided completely free of charge as a complementary tool to the physical cards. Therefore, the software is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the software will be uninterrupted, bug-free, or completely secure.

4.2 Acceptable Use

You agree not to reverse engineer the code generation algorithm, attempt to breach the platform's security, or use the Services to distribute spam or malicious content.

We reserve the right to suspend or terminate your account and access to the software at our sole discretion, without notice, if we determine that you have violated these Terms, engaged in fraudulent use of the code system, or harmed the reputation of HotelHook.

7. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Delaware.

8. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through a notice in the software dashboard. Your continued use of the Services following such notification constitutes your acceptance of the updated Terms.
